MEMBERSHIP AGREEMENT

It is recommended that the Membership Agreement, which includes the terms, rules and legal responsibilities set out below, be read by www.roseverplus.com visitors before use.

In case the specified terms and conditions are not suitable for you, please do not use www.roseverplus.com. By using the site and filling out the form with your personal information, you are considered to have accepted the terms written on these pages.

Membership Agreement

  1. Parties

This agreement has been arranged between BE ONE Mobile Online Sales Marketing Food Cosmetics Production Trade and Industry Inc. (hereinafter referred to as "BeOne") and the user logging in to www.roseverplus.com for the purpose of the user becoming a member of the site and in the electronic platform where the relevant site is located.

  1. Terms of Use

www.roseverplus.com is open to all members. The services provided on the site are free of charge unless otherwise stated. In the following written cases, www.roseverplus.com may prevent the member from using the site and accessing the content and reserves its legal rights against the person or persons involved in the following attempts:

  • Incomplete, inaccurate, irregular and misleading information, containing expressions that do not comply with the general rules of morality and contrary to the laws of the Republic of Turkey in the event that information is recorded on the site,
  • In the event that the works and content on the site are partially or completely copied and used or attempted to be used for different purposes,
  • In case of using software that will threaten the security of the site, preventing the operation of the site and the software used, carrying out activities, attempting to do so, and receiving, deleting, changing information,
  • The user is directly responsible for any damages that may arise from the sharing of information such as passwords given to the users or determined by them, usage rights, with third parties or organizations (use of this information by persons other than the user). Likewise, the user cannot use personal information such as IP address, e-mail address, e-mail address belonging to someone else on the internet, nor can the user access or use the private information of other users without permission. The user is considered to have accepted all kinds of legal and criminal liabilities that may arise from such use.
  1. Content Usage
  • The visual and written content presented on www.roseverplus.com is for personal use. www.roseverplus.com is the owner or licensee of all stores, icons, logos, visual, written, electronic, graphic or machine-readable technical data, applied sales system, business method and business model, including all materials and related intellectual and industrial property rights and are under legal protection. Unless otherwise stated, they may not be used for commercial or personal purposes without authorization or reference. It is forbidden to publish any element of this site in any other media or website or to link to www.roseverplus.com.
  • The software used in the design of these pages and the creation of the database is the property of BeOne. Copying or use of said software is strictly prohibited.

  1. Responsibilities

 

  • After the user of www.roseverplus.com fills in the sections required for registration and confirms his e-mail address, he may start using the www.roseverplus.com site by entering his e-mail address and password, provided that he complies with the conditions specified in this agreement.
  • The user agrees to comply with the Turkish Penal Code, Turkish Commercial Law, Law on Intellectual and Artistic Works, Decree Laws and legal regulations on the Protection of Trademark and Patent Rights, Law of Obligations, other relevant legislation provisions and all kinds of announcements and notifications that www.roseverplus.com will publish regarding its services while using the www.roseverplus.com site and services. All kinds of legal, criminal and financial responsibilities that may arise due to use contrary to these notices and laws belong to the user.
  • The information of users who visit www.roseverplus.com (frequency of visits, visit times, etc.) is followed in order to serve them better. This information, adhering to confidentiality terms, in order to expand and improve the content, advertising, etc. It is shared with companies that cooperate in matters. The purpose here is to improve the service offered by the site to its users and to enrich the content offered by www.roseverplus.com.
  • The user may not take actions that make it difficult or prevent other users and visitors from using www.roseverplus.com, and may not install automatic programs and force/lock servers or databases. It cannot make cheating attempts. If found, it accepts that its membership will be cancelled and accepts any legal and criminal liability that may arise from the situation.
  • In case it is determined that the user does not comply with the obligations specified in this agreement or the general rules announced on www.roseverplus.com, the user's access to www.roseverplus.com may be blocked for a period of time / indefinitely.
  • Different rules and obligations specific to that section may be specified in certain parts of the site. Person and organizations using these sections are deemed to have accepted these rules in advance.
  • It is the responsibility of the persons to take backup of the messages made with www.roseverplus.com and it is recommended by www.roseverplus.com. BeOne cannot be held responsible for loss, deletion or damage due to failure to make backups.
  • The user may not remove or delete Copyright, Trademark and all kinds of Intellectual and Artistic Works Law on any material copied or printed from www.roseverplus.com.
  • The relations of the site users with each other or with third parties are the responsibility of the individuals.
  • Membership cancellation and account deletion can be done by the user via www.roseverplus.com. The login authority of the user who terminates his membership will also be cancelled.
  • The decision whether or not to delete any record of the user account terminated by the user in www.roseverplus.com belongs to roseverplus.com. The user cannot claim any rights or compensation for deleted records.
  • BeOne reserves the right to use all information linked to your user account for its own marketing activities, subject to the terms of use, privacy principles and applicable legal regulations.

The user agrees that he/she shall be deemed to have accepted all provisions of this participation agreement from the moment he/she starts to benefit from the service and that the agreement shall be effective against him/her. The user agrees to indemnify BeOne for any damages incurred by BeOne due to its behavior contrary to the obligations undertaken by this agreement. BeOne has the right of recourse to the user for any compensation and / or administrative / judicial fines that the user may have to pay to public institutions and / or third parties due to the user's behavior contrary to the contract.

  1. Rights and Obligations of BeOne

BeOne accepts and undertakes that the user will benefit from the services subject to the contract, except for technical failures, and that the information other than the personal information that the user opens to sharing will not be shared with third parties or organizations except for legal obligations. In case it is determined that the user has caused any electronic sabotage, attempts to interfere with earnings and / or attack that will prevent the operation of the www.roseverplus.com site, or if a criminal complaint or official investigation request is received from the official authorities against the member, www.roseverplus.com has the right to investigate and disclose the identity information of the relevant member. BeOne may make unilateral changes to this agreement without any notice in order to ensure the continuity of the services it undertakes. BeOne always has the right to unilaterally, without any justification, to stop the service permanently or temporarily, to change or cancel the content of the service. The user accepts this right. In case of any change, BeOne will publish the current terms of use on its website under the same link with the new date update and will notify its users by e-mail if deemed necessary. The revised current terms of use will be valid from the moment it is published on www.roseverplus.com and the use of the www.roseverplus.com site or services will be subject to the revised terms of use from that moment on.

The membership of the member who has sent materials contrary to the provisions of this agreement to www.roseverplus.com may be unilaterally terminated by BeOne without any notice.

  1. Entry into Force of the Contract

The user is accepted to have undertaken to comply with the www.roseverplus.com agreement from the moment he/she fills in and approves the registration form or receives or orders any service using this system. The contract shall automatically become null and void without any warning upon termination of membership or upon the realization of any of the termination situations listed in this contract.

 

  1. Notification Addresses

www.roseverplus.com does not request postal addresses from its users who are members of the site in advance. However, the e-mail address that the user notifies to www.roseverplus.com is accepted as the e-mail from which the legal address will be requested for any notification to be made regarding this agreement.

Unless the parties notify the other party in writing of changes in their existing electronic mails within 3 (three) days, they agree that requests to old electronic mails will be valid and deemed to be made to them.

Any notification that www.roseverplus.com will make using the user's registered e-mail address will be deemed to have reached the user 1 (one) day after the electronic mail is sent by www.roseverplus.com.

The user declares, accepts and undertakes that he/she has read, understood, accepted all of the articles in this participation agreement and confirms the accuracy of the information provided about himself/herself.

By clicking on the link "If you do not want to be notified of campaign announcements, please click here." at the bottom of the e-mails sent from www.roseverplus.com, or "I want to receive notifications via e-mail" in the "Personal Information" section on the site. You can easily unsubscribe from the mailing list by revising your selection.

The user agrees that the information shared by the user may be classified and stored on a database and that the company may use the user's usage and transaction information for the period required for performance evaluations, marketing campaigns of the company and its business partners, annual reports and similar transactions, and that such data may be used by taking the necessary security measures, may be transferred to infrastructure providers and third parties from whom services are received only for the realization of the purposes mentioned in the contract, and may be stored and processed by these persons in data centers located in Turkey or abroad.
